Welcome to Ezzey Digital Marketing ("Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of all digital marketing services, platforms, and products offered by Ezzey Digital Marketing, including but not limited to our BOOST Program. By purchasing, accessing, or using any service from Ezzey Digital Marketing, you agree to be bound by these Terms, our Privacy Policy, and any applicable supplemental agreements.

Ezzey provides a variety of marketing solutions, including:

Local SEO & Google Business Profile optimizationPay-Per-Click advertisingSocial media content and management. Web development & hostingReputation managementBOOST: Local SEO & visibility enhancement package. Each service may have specific deliverables, timelines, and usage rules outlined in individual scopes of work, proposals, or agreements.

3. Eligibility & Representation

By engaging with our services, you represent that:

You are at least 18 years of age. You are authorized to act on behalf of the business or entity listed in your agreement. All information you provide to Ezzey is truthful and up to date.

4. BOOST Program Guarantee Terms

The BOOST Program offers a 60-Day Measurable Google Business Profile Ranking Improvement Guarantee, subject to strict eligibility and compliance terms. Clients must meet all eligibility criteria outlined here and in the BOOST onboarding documentation.

Guarantee Limitations

We reserve the right to withdraw or deny the Guarantee if:

The Google Business Profile (GBP) is improperly set up or flagged for spam/fraudThe GBP shows signs of shadow banning, manipulation, or past TOS violationsThe Client fails to provide timely access, credentials, or requested materialsUnauthorized changes are made to NAP, categories, or content during the guarantee period.

Right to Exit

Ezzey reserves the right to terminate services and/or void the Guarantee under reasonable suspicion of prior unethical SEO activity, false business claims, or interference from outside vendors.

5. Payments & Billing

All services are billed according to agreed rates and terms. Late or declined payments may result in the suspension of services. Recurring services auto-renew unless canceled in writing with a 7-day notice. Ezzey reserves the right to adjust pricing and service inclusions with advance written notice.

6. Termination & Refunds

Either party may terminate services with written notice. Refunds are not guaranteed and are handled on a case-by-case basis. Under BOOST, the Company’s maximum liability is limited to refunding fees for unused months beyond the initial 60 days, where applicable.

7. Client Responsibilities

Clients agree to:

Provide all requested access, content, approvals, and logins in a timely manner. Avoid engaging with other vendors in areas Ezzey is optimizing without prior notice. Maintain an active business presence and valid GBP. Failure to meet responsibilities may result in voided guarantees or halted services.

8. Intellectual Property

All creative assets, strategies, and campaign materials developed by Ezzey remain our property unless otherwise agreed in writing. Clients retain ownership of their own existing brand elements and platforms.

9. Confidentiality

Both parties agree to maintain the confidentiality of proprietary business, marketing, and client data shared during the engagement. This survives the termination of services.

10. Limitation of Liability

Ezzey shall not be liable for:

Loss of revenue, traffic, or opportunity due to search engine changes. Third-party platform errors or outages. Delays caused by client inaction or miscommunicationAny damages exceeding the total amount paid to Ezzey within the last 60 days.

11. Disclaimers

We make no guarantees of specific revenue, ranking, or lead volume, unless explicitly stated in writing. Marketing performance varies by industry, competition, and platform policies.

12. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the State of Arizona, without regard to conflict of law principles. Any legal disputes must be brought in the state or federal courts located in Maricopa County, AZ.

13. Updates to Terms

We may update these Terms at any time. Continued use of our services following updates constitutes agreement to the revised terms. The most current version will always be posted on our website.
